Terms of Service
1. About CaseScribe
CaseScribe ("the Service", "we", "us") is an AI-assisted medical writing tool that helps clinicians generate structured case report abstracts and journal-ready manuscripts. CaseScribe is operated as an independent SaaS product for individual medical professionals worldwide.
CaseScribe is a writing assistance tool only. It does not provide clinical diagnosis, medical advice, or treatment recommendations. It is not a medical device, clinical decision support system, or Software as a Medical Device (SaMD).
2. Eligibility
You must be:
- A licensed or registered medical professional (physician, surgeon, specialist, or equivalent)
- At least 18 years of age
- Using the Service for professional medical writing purposes only
By creating an account, you confirm you meet these criteria.
3. Anonymisation — Mandatory Requirement
This is the most important clause in this agreement. Read it carefully.
3.1 You must anonymise all clinical notes before submission
You must completely remove all patient-identifying information from any clinical notes you submit to CaseScribe. This includes but is not limited to:
- Patient full name, initials, or nickname
- Date of birth, exact age if identifying
- Hospital or clinic name, ward, or bed number
- Medical Record Number (MRN), National ID, Emirates ID, or any government identifier
- Home address, city of residence (if identifying)
- Employer, workplace, or any occupational detail that could identify the patient
- Photographs, imaging, or any media containing identifying features
- Family member names or relationships that could identify the patient
- Any combination of details that could identify the patient when combined
3.2 Your responsibility
You are solely responsible for ensuring all submissions are fully anonymised before use. CaseScribe applies automated checks to flag obvious identifiers, but these are not infallible. Responsibility for anonymisation lies entirely with you.
3.3 Legal basis
In jurisdictions where patient health data is regulated (including but not limited to UAE Federal Law No. 2 of 2019 on the Use of Information and Communication Technology in Health Fields, HIPAA in the United States, GDPR in the European Union, and equivalent laws), you are responsible for ensuring that any data submitted to CaseScribe complies with applicable law.
By submitting clinical notes, you warrant that:
- The data has been fully anonymised and cannot reasonably be used to identify the patient
- You have obtained any necessary patient consent for publication (as required by your institution and/or target journal)
- Submission of the data does not violate any applicable law or professional obligation
3.4 Patient consent for publication
You are responsible for obtaining written informed consent from the patient (or their legal guardian) for publication of the case report, in accordance with your institution's requirements and target journal policies. CaseScribe inserts a standard consent statement in all manuscript exports as a placeholder — you must replace this with confirmation that real consent was obtained.
4. AI-Assisted Writing — Disclosure and Limitations
4.1 Nature of the Service
CaseScribe uses Claude (Anthropic) to generate written content. All output is AI-assisted and must be reviewed, verified, and approved by you before any submission to a journal or other publication.
4.2 AI Disclosure Requirement
All manuscript exports include the following AI disclosure statement in accordance with ICMJE recommendations:
"This manuscript was prepared with AI writing assistance (CaseScribe, powered by Claude, Anthropic). The clinical content, interpretation, and conclusions were reviewed and approved by the author(s). AI assistance is disclosed in accordance with ICMJE recommendations."
You must retain this disclosure in any manuscript submitted to a journal. Removing or concealing this disclosure may violate journal policies and professional ethics standards. CaseScribe takes no responsibility for consequences arising from failure to disclose AI assistance.
4.3 Author responsibility
You are the author of any manuscript produced using CaseScribe. You are responsible for:
- Verifying the accuracy of all clinical facts against the source notes
- Verifying all references cited in the manuscript
- Ensuring the manuscript meets the requirements of your target journal
- Ensuring compliance with ICMJE authorship criteria
- Final submission and all editorial correspondence
CaseScribe makes no warranty that output will be accepted by any journal or pass any editorial review.
4.4 Reference accuracy
CaseScribe's paid manuscript generation uses live PubMed search to retrieve real references. Despite this, you must independently verify all references before submission. CaseScribe is not liable for inaccurate, retracted, or misattributed citations in the output.
5. Acceptable Use
You agree NOT to use CaseScribe to:
- Submit identifiable patient data (see Section 3)
- Generate fraudulent, fabricated, or plagiarised content
- Submit another clinician's work as your own
- Circumvent journal AI disclosure policies
- Use outputs for commercial purposes unrelated to your own professional medical writing
- Reverse-engineer, scrape, or attempt to extract the underlying AI system
- Submit clinical notes for patients where you are not the treating or supervising clinician
6. Payments and Credits
6.1 Pricing
- Single report credit: $9 USD
- Five-report credit pack: $35 USD
Credits are non-refundable once a manuscript generation has been initiated.
6.2 Refund policy
If a manuscript generation fails due to a technical error on our side (not user error or incomplete input), we will restore the credit to your account. We do not issue cash refunds except where required by applicable law.
6.3 Payment processing
Payments are processed by Stripe. CaseScribe does not store your payment card details. By making a payment you agree to Stripe's Terms of Service.
7. Data and Privacy
7.1 What we store
We store your account information (name, email), usage logs (timestamps, credit balance, number of reports generated), and — temporarily — submitted clinical notes and generated outputs for the duration of your session.
7.2 What we do not store
We do not permanently store your submitted clinical notes or generated manuscripts beyond the active session. Outputs are delivered to you directly and then deleted from our servers.
7.3 Third-party processing
Your submitted notes are transmitted to Anthropic's Claude API for processing. Anthropic's data handling practices are governed by Anthropic's Privacy Policy and API Terms. By using CaseScribe, you consent to this transmission.
7.4 No sale of data
We do not sell, rent, or share your data with third parties for marketing purposes.
8. Intellectual Property
CaseScribe and its underlying technology, branding, and system prompts are the intellectual property of CaseScribe. The generated manuscript content is yours — you own the output you generate using your clinical notes.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. CASESCRIBE MAKES NO WARRANTY THAT:
- — OUTPUT WILL BE ACCURATE, COMPLETE, OR FIT FOR PUBLICATION
- — REFERENCES WILL BE CURRENT, ACCURATE, OR UNRETRACTED
- — THE SERVICE WILL BE AVAILABLE WITHOUT INTERRUPTION
- — OUTPUT WILL COMPLY WITH ANY SPECIFIC JOURNAL'S REQUIREMENTS
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASESCRIBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: JOURNAL REJECTION, PROFESSIONAL CONSEQUENCES, PUBLICATION ERRORS, OR DATA LOSS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE CREDIT THAT GAVE RISE TO THE CLAIM.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which CaseScribe is incorporated. Any disputes shall be resolved through binding arbitration or the courts of that jurisdiction.
12. Changes to These Terms
We may update these Terms at any time. We will notify you by email and/or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
